• Return and replacement of goods
    1. 1. The Buyer has the right to return the Goods (to cancel the contract of sale and purchase concluded in the Store) if no more than 14 calendar days have elapsed since the date of delivery of the goods and if no restrictions apply to the return/withdrawal under clause 11 of these Rules, or by any other legal act.
    2. Any Buyer who cannot be considered a consumer under the applicable consumer rights legislation, i.e. legal and natural persons purchasing Goods for business, commercial or professional purposes (purchasing the Goods for non-personal/family use, or not for the Buyer’s own household use) may not return Goods of merchantable quality.
    3. The Buyer shall not be entitled to return Goods of merchantable quality if such Goods fall within statutory exceptions (unless the applicable law requires the Seller to accept the return of such Goods or if the distance contracts for the purchase of such Goods cannot, in accordance with the Terms, be terminated by Buyers without good cause). For example, the Seller is not obliged to accept the return of the following Goods:
      1. Perishable products as well as products with a short shelf life.
      2. Products that have been sold packaged but which have been removed from their packaging after delivery and are unsuitable for return due to health or hygiene reasons (e.g. most cosmetic products).
      3. Images or sound recordings and software if they were sold packaged but removed from their packaging after delivery.
      4. Periodical publications including newspapers and magazines.
    4. The Buyer shall not be entitled to return Goods of merchantable if they have been used after delivery, damaged, or have lost their marketable appearance (including if labels have been removed and/or damaged, protective films have been removed, etc.), or if they have lost their consumable properties.
    5. Upon return of the Goods by the Buyer, the following conditions must be met:
      1. The item to be returned must be in its original neat packaging.
      2. The Product must be undamaged by the Buyer.
      3. The product must be unused and in good condition (intact labels, protective film, etc.). This clause shall not apply in the case of return of a defective Product.
      4. The item must be returned in the same condition in which the Buyer received it.
      5. Return of the Item for refund or replacement requires proof of purchase.
    6. The Buyer shall not be entitled to return Goods of merchantable quality if the terms for refunds specified in these Rules and/or applicable legislation have not been met.
    7. In order to return the delivered Item, the Buyer shall submit a return request by e-mail to info@trakaimuziejus.lt stating the item, order number and delivery date. The Seller shall have the right to ask the Buyer to provide other information that is necessary to ensure the proper exercise of the Buyer’s rights, including special request forms.
    8. Upon making a reasonable request to return the Goods, the Buyer shall return a non-perishable Product not later than within 14 calendar days from the date of submission of the request to return. In the case of a perishable Product, return must be within 72 hours unless the Seller specifies a longer term. The Buyer shall coordinate the particular item, time and place of delivery with the Seller, who shall contact the Buyer using the contact method specified by the Buyer in his/her request for a return.
    9. The cost of returning Goods of merchantable quality shall be covered by the Buyer. The cost of returning defective Goods shall be covered by the Seller.
    10. In the case of Goods of merchantable returned to the Seller, the Seller shall refund to the Buyer the Price paid to the Seller within 14 calendar days of the return of the Goods by transferring this amount to the bank account from which the Buyer made the payment for the Order. 
    11. The Seller shall have the right not to accept the Goods returned by the Buyer if the Buyer does not follow the procedure for the return the Goods set out in these Rules. If the Seller determines that the Buyer has violated his/her obligation to return an undamaged, unadulterated product of merchantable quality, the Buyer undertakes to reimburse the Seller for all related losses and the Price paid shall not be refunded to the Buyer.
    12. If the Product delivered to the Buyer is not the one that was ordered, and/or is of not of merchantable quality, the Seller undertakes to take back the Product and replace it with an item of merchantable quality or to refund the Price paid for the item if no suitable Goods are available for replacement.
    13. If the Buyer wishes to replace defective Goods with Goods of another type, he/she must indicate the names or reference numbers of the Goods he/she wishes to receive in lieu of the returned Goods. If the value of the new Goods exceeds the value of the returned Goods, the difference must be paid in accordance with the invoice sent by the Seller. If the value of the new Goods is less than the value of the returned Goods, the Seller will refund this excess amount within 30 calendar days to the Buyer’s bank account from which the payment for the Goods order was made.
