Rules for the sale and purchase of goods in the e-shop of budgetary institution Trakai History Museum (‘Trakų istorijos muziejus’)

  • Definition of terms
    1. Rules – the rules for the sale and purchase of goods in the online shop eshop.trakaimuziejus.lt.
    2. Seller – the budgetary institution Trakai History Museum, legal entity code 190757189, address Kęstučio g. 4, Trakai, LT-21104 Lithuania.
    3. Buyer – any natural or legal person who, under the procedures established by the laws of the Republic of Lithuania, has the right to enter into transactions in his/her own name, or duly authorised representatives of such persons.
    4. Shop – the Seller’s e-shop, eshop.trakaimuziejus.lt.
    5. Goods – goods purchased from the Seller’s e-Shop.
    6. Price – the prices of the Goods as stated in the Seller’s e-Shop in EUR including VAT and payable to the Seller in exchange for the Goods.
    7. Delivery fee – the delivery service fee indicated in the Seller’s e-Shop in EUR, including VAT, and payable to the Seller and / or its courier for the delivery of the Goods.
    8. Courier – a third party providing goods delivery services.
  • General provisions
    1. These Rules determine the procedure for using the online shop eshop.trakaimuziejus.lt.
    2. These Rules also define the rights, obligations, responsibilities and procedure for purchases, payment, delivery, return of Goods and other issues relating to the purchase and sale of Goods in the Shop.
    3. These Terms and Conditions shall become a binding document from the moment the Buyer becomes acquainted with and agrees with them by ticking the checkbox “I have read and agree to the Online Store Rules”.
    4. The Buyer, by accepting the Terms, confirms that he/she has the right to purchase Goods from the Store, i. e. that he/she complies with the criteria specified in Rule 1.3. p.
    5. Taken together, these Terms constitute a distance selling and purchase contract between the Buyer and the Seller.
  • Conclusion of the contract
    1. A contract between the Buyer and the Seller shall be deemed to be concluded from the moment when the Buyer places the Goods into the Shopping Cart of the Shop, chooses the delivery method for the Goods, selects a payment method, confirms that he/she has read the Rules and presses the “Order” button.
    2. The Buyer shall not be given the opportunity to make purchases in the Store if he/she is not familiar with and/or disagrees with the Rules. If the Buyer orders the Goods in the Store, the Buyer shall in all cases be deemed to have read and fully accepted all provisions of the Terms and shall bear any risk of possible inaccurate understanding of the Rules.
    3. The Seller shall have the right to withdraw from the contract for the sale and purchase of the Goods if the Goods specified in the contract are out of stock, or if the contract was concluded by a person who was not entitled to conclude the contract under these Rules.
  • Rights and obligations of the Buyer
    1. The Buyer has the right to purchase Goods from the Store in accordance with the procedure set forth in these Rules and other legal acts of the Republic of Lithuania.
    2. The Buyer undertakes to accept the Goods ordered and to pay the Price in exchange for them.
    3. The Buyer has other rights and obligations specified in these Rules and in the legal acts of the Republic of Lithuania.
  • Rights and obligations of the Seller
    1. The Seller undertakes to enable the Buyer to properly use the Shop.
    2. The Seller undertakes to respect the Buyer’s right to privacy in respect of the Buyer’s personal information.
    3. The Seller shall have other rights and obligations specified in these Rules and in the legal acts of the Republic of Lithuania.
  • Prices of goods
    1. Goods are sold to the Buyer at the Prices specified in the Store at the moment at which the order is placed.
    2. The Seller shall have the right to determine the minimum monetary value of the Price of Goods that the Buyer must order from the Store if he/she wishes to place an order (and, consequently, to enter into a contract for the sale and purchase of Goods and to receive the Goods delivery service). The Delivery Fee is not included in this minimum order amount.
  • Delivery fee
    1. The delivery charge shall be calculated and applied at the time at which the Buyer places the order for the Goods. This charge may be fixed or may be subject to change depending on the value of the Goods ordered by the Buyer and/or the delivery terms. The Buyer shall in any event be subject to the Delivery Fee indicated at the time that the Order for the Goods is placed.
    2. If the Shop system allows the Buyer to add more items to the shopping cart after the Order has been confirmed, the delivery service fee may change.
  • Payment procedure
    1. The Buyer pays for the Goods at the time of the Order by making a pre-payment via the Paysera.lt online payment system. This system receives from the Seller's Shop only the order number and the amount, which is forwarded to the electronic system of the settlement bank chosen by the Buyer. Payment takes place within the electronic environment of the Buyer’s bank, wherein the Buyer confirms the completed payment order form.
