  • Ordering and delivery of goods
    1. The Buyer can shop in the store 24 hours a day, 7 days a week.
    2. The Buyer should immediately contact the Seller by phone on +370 (528) 55297 (8:00 am to 5:00 pm on working days) or e-mail d.stefanoviciene@trakaimuziejus.lt (at any time) if they notice an error in their Order or wish to cancel their order.
    3. Upon receipt of confirmation of the proper payment for the Goods from the Payment System Operator, the order shall be carried out and the calculation of time for delivery of the Goods starts.
    4. If the Buyer wishes to receive a VAT invoice, the Seller shall issue and send such a receipt to the Buyer by e-mail to the address specified in the Buyer’s order within 3 business days after the delivery of the Goods.
    5. The places to which the Seller’s Couriers are able to deliver the Goods may be checked in the information published in the Store. These may be specified and modified at the sole discretion of the Seller.
    6. The Buyer (or other person accepting delivery of the Goods) must check the Goods delivered by the Seller’s Courier before accepting them, and not approve the proper delivery, transfer and acceptance of the Goods if he/she discovers any discrepancy in the quantity, quality, assortment or other aspect of the Goods, or damage to the Goods or their packaging. After confirming the proper delivery, transfer and acceptance of the Goods, the Purchaser shall not subsequently be entitled to claim any of the above discrepancies.
    7. If, in checking the condition of the Goods delivered, the Buyer identifies any discrepancies in the quantity, quality, assortment or other aspect, he/she shall inform the Seller’s Courier who delivered the Goods, who shall record such discrepancies in the system administered by the Courier.
    8. Goods not of merchantable quality, Goods that were not ordered or which were delivered in excess of the quantity ordered, shall be returned to the Seller’s Courier.
    9. The Seller’s Courier delivers the ordered Goods to the Buyer at the time, and within time period, indicated by the Buyer in the order for the Goods.
    10. The Seller and/or the Seller’s Courier will always make every effort to ensure the delivery of the Goods at the time chosen by the Buyer or, upon the Buyer’s choice for immediate delivery, within the shortest time reasonably possible. The Seller cannot guarantee that all Goods will always be delivered on time without any hindrance. Therefore, the Seller shall not be liable for any delay in the delivery of the Goods due to the circumstances beyond the Seller's control. In the event of a delay in the delivery of the Goods, the Seller or the Seller’s Courier shall contact the Buyer to arrange a mutually acceptable solution to the situation. The Courier shall be responsible for the delivery of the Goods to the Buyer at the address and time of the Buyer’s choosing.
    11. The Buyer undertakes to accept the Goods delivered by the Seller’s Courier at the delivery address specified by the Buyer in the Store System and at the time chosen by the Buyer to accept the order for the Goods. The Seller shall not be liable for the proper performance of its contractual obligations if the Buyer provides an incorrect address or if the Buyer cannot be found at the specified address at the time of delivery.
    12. If the Seller’s Courier cannot find the Buyer at the address specified by the Buyer, the Courier shall be entitled to transfer the Goods to another adult at the delivery address specified by the Buyer, which shall be deemed to be the proper fulfilment of the Seller’s contractual obligations, while the confirmation of that other person in relation to the delivery, transfer and receipt of the Goods shall be considered a proper confirmation.
    13. If the Seller’s Courier cannot find the Buyer at the address specified by the Buyer at the time of delivery chosen by the Buyer, and no other person is present who meets these Terms and/or applicable legislation, and to whom the Seller’s Courier could transfer the delivered Goods, the Seller shall be deemed to have fulfilled its contractual obligations properly, and shall not be required to re-attempt delivery of the Goods at another time or address, and the Buyer shall not be refunded the Goods Delivery Fee.
    14. In the cases specified in Clause 9 of the Rules, the Seller shall inform the Buyer of the address of the place of storage of the Goods, and shall allow the Buyer to collect such Goods at a mutually agreed time and at the Buyer’s own expense. In such a case, the Seller undertakes no special storage conditions for the Goods and assumes no responsibility for the quality of Goods that were not received at the agreed time and address specified in the Order (including but not limited to their use, appearance, preservation, usability, safety, etc.)
  • Quality of goods
    1. The particulars of each item sold in the Store shall be indicated in the description placed next to the item.
    2. The Seller shall not be liable if the Goods displayed in the Store differ in colour, shape or other parameters from the actual Goods delivered due to discrepancies in the information transmission process, such as the characteristics of the monitor used by the Buyer or for other technical reasons, taking into account any reasonably possible discrepancies in appearance.
    3. The characteristics of the Goods offered for sale by the Seller in the Store are provided in the descriptions of the Goods announced by the seller, but may be prepared and provided by third parties who control the physical retail locations in which the Goods are sold. Responsibility for the descriptions prepared and the quality of the Goods sold, including information about the characteristics of the Goods (its correctness, accuracy, completeness, proper presentation, and compliance with other regulatory requirements), to the maximum extent permitted by law, falls upon and lies with those legal persons who own the physical retail outlets from which the Seller buys and its Couriers collect the Goods, as well as with the manufacturers and/or importers of such Goods.
    4. Unless the Seller specifies a specific warranty period for a Product, Products shall be subject to the warranty provided by the applicable law.
